1. Acceptance of Terms

1.1 Definitions

For the purposes of these Terms:

• "We", "Us", "Our" or "Company" refers to KON PARTNERS LLP, a limited liability partnership registered at 27 Old Gloucester Street, London, United Kingdom, which operates the MyDates mobile application, website, and related services.
• "You", "Your" or "User" refers to the individual accessing or using the App, Site, or Services.
• "App" refers to the MyDates mobile application available on mobile devices.
• "Site" refers to our website and any web-based interfaces or pages that provide access to or information about the MyDates application and services.
• "Services" refers to the MyDates mobile application, our website, and all related features, functionality, and services, including but not limited to birthday and event management, notifications, widgets, data export/import, holiday database access, AI bot services, third-party integrations, and video/image services.
• "Terms" or "Terms of Service" refers to these Terms of Service and any updates or modifications thereto.

1.2 Acceptance

By downloading, installing, accessing, or using the App, Site, or Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App, Site, or Services. We may update these Terms from time to time, and your continued use of the App, Site, or Services after such changes constitutes acceptance of the updated Terms.

2. Who May Use the Services

The Services are only intended and licensed for individuals aged thirteen (13) years or older. If you are under 13 years, you may not download or use the App or access the Services. If you are between 13 and 18 years of age, then you must review this Agreement with your parent or guardian before using the Services, and your parent or guardian must agree to this Agreement on your behalf. By using the Services, you represent that you (or your parent or guardian on your behalf) can form a binding contract under applicable law, are not barred from using the Services under the laws of applicable jurisdiction, and that you will comply with these Terms and all applicable local, state, national and international laws, rules and regulations. The Services are not intended for distribution to or use in any country where such distribution or use would violate local law or would subject us to any regulations in another country. We reserve the right to limit the Services in any country.

3. Description of Services

MyDates is a mobile application that provides the following services:

3.1 Birthday and Event Management

• Create, edit, and delete birthday and event records

3.2 Notification Services

• Push notifications for upcoming birthdays and events
• Customizable notification timing and advance notice settings

3.3 Home Screen Widget

• Display of nearest upcoming events on your device's home screen
• Customizable widget appearance

3.4 Data Management

• Export and import of event data
• Optional AES-256-GCM password-protected encryption for exported data

3.5 Holiday Database

• Access to holidays' database
• Holiday images and sharing functionality

3.6 AI Bot Services

• AI-powered congratulation message generation
• Text content generation based on event information
• Multi-language support for generated content

3.7 Third-Party Integrations

• Google OAuth for account creation and authentication
• Google Drive backup and restore functionality
• Calendar import from device calendar
• Contacts import from device address book

3.8 Video and Image Services

• Birthday card images and videos
• Video playback with ExoPlayer
• Image and video sharing functionality

3.9 Share With Your Contacts Service

The Services include an invitation service that enables you to invite your friends and contacts to download and use the Services. If you choose to participate in the Share With Your Contacts Service, you acknowledge and agree:

• To only send invitations to your friends and contacts whom you know
• Not to misrepresent your relationship with us or make any warranty or representation on our behalf, which would in any event be void and of no effect
• To comply at all times with these Terms and applicable law

3.10 Advertisements

• Display of advertisements within the App
• Personalized advertising based on your preferences and upcoming events

3.11 App Add-ons and In-App Purchases

• Optional enhanced features and functionalities available for purchase
• In-app purchase system for premium features

4. Account Creation and Google OAuth

To use certain features of the App, you may be required to create a MyDates account using Google OAuth. By using Google OAuth, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Accept Google's Terms of Service and Privacy Policy
• Be responsible for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We collect your name, profile picture, and email address from Google for account creation purposes. This information is handled in accordance with our Privacy Policy.

5. User-Generated Content

You retain ownership of all content you create, upload, or store in the App, including:

• Birthday and event records (names, dates, notes)
• Your images and photos
• Custom categories and labels
• Any other Personal Data (as defined in our Privacy Policy) you input into the App

By using the App, you grant us a limited license to store, process, and display your content solely for the purpose of providing the App's services to you. You are solely responsible for the accuracy, legality, and appropriateness of your content. Your content is handled in accordance with our Privacy Policy.

6. Data Export and Import

The App provides functionality to export and import your event data:

6.1 Export Features

• You may export your data in plain format
• You may export your data in encrypted format using AES-256-GCM encryption
• Encrypted exports require a password
• You are responsible for maintaining the security of your export files and passwords

6.2 Import Features

• You may import data from files which you created with Export Features
• Encrypted files require the correct password for decryption
• We are not responsible for data loss resulting from incorrect passwords or corrupted files
• Imported data replaces existing data in accordance with the import process

7. Third-Party Services

The App integrates with several third-party services:

7.1 Google Services

• Google OAuth: Used for account authentication. Your use of Google OAuth is subject to Google's Terms of Service and Privacy Policy.
• Google Drive: Used for backup and restore functionality. Your use of Google Drive is subject to Google's Terms of Service and Privacy Policy. We only access your Google Drive to store and retrieve backup files as requested by you.

7.2 Device Permissions

• Calendar Access: The App may request access to your device calendar to import events. You may grant or deny this permission. We only access calendar data to populate your MyDates database with events you choose to import.
• Contacts Access: The App may request access to your device contacts to import birthday information. You may grant or deny this permission. We only access contact data to populate your MyDates database with events you choose to import.
• Notifications: The App requires notification permissions to send you reminders. You may configure notification settings within the App.

7.3 Third Party Software

Portions of the Services include third party software that may be subject to the terms and conditions imposed by the licensors of that third party software ("Third Party Terms"). A list of the third party software and related Third Party Terms is available at https://mydates.life/open-source-compliance. If there is a conflict between any Third Party Terms and these Terms, the Third Party Terms shall prevail in connection with the related third party software.

8. Advertisements

The App may display advertisements ("Ads") to users. By using the App, you acknowledge that:

• Ads may be displayed within the App interface
• We may use your Personal Data (as defined in our Privacy Policy) to present you with Ads that may be of greater interest and tailored to you and your upcoming events
• We do not share your Personal Data with third-party advertisers for their advertising purposes
• Third-party ad servers may use cookies, web beacons, clear gifs, or similar technologies to help present advertisements and measure their effectiveness
• The use of these technologies by third-party ad servers is subject to their own privacy policies
• You may have options to limit or control certain types of advertising, subject to App settings and availability

9. App Add-ons and In-App Purchases

The App may include the option to purchase certain enhanced features or functionalities for the App (collectively, "App Add-ons"). App Add-ons may be available as one-time purchases or as periodic subscriptions (e.g., monthly, annual, or other billing periods). By purchasing App Add-ons, you agree to:

• Pay the specified price for the App Add-on at the time of purchase or subscription activation
• For subscriptions: Understand that subscriptions will automatically renew at the end of each billing period (monthly, annual, or as otherwise specified) unless you cancel the subscription before the renewal date
• For subscriptions: Acknowledge that you are responsible for managing your subscription and cancellation through your device's app store settings or as otherwise provided in the App
• For subscriptions: Understand that cancellation of a subscription will take effect at the end of the current billing period, and you will continue to have access to the subscribed features until the end of that period
• Review and be bound by the terms of use and privacy policy of any third-party service providers used to process transactions
• Understand that purchases are final and non-refundable unless required by applicable law
• Acknowledge that App Add-ons may be subject to device compatibility requirements and may not be available on all devices

We use the tools, software, or services of third-party service providers to process transactions on our behalf. You acknowledge and agree to review and be bound by the terms of use and privacy policy of those third-party service providers.

10. AI Bot Services

The App includes an AI-powered bot that generates congratulation messages, text and graphic content:

• AI-generated content is provided "as is" without warranty
• We do not guarantee the accuracy, appropriateness, or quality of AI-generated content
• You are responsible for reviewing and editing AI-generated content before use
• AI services may be subject to usage limits or restrictions
• We reserve the right to modify, suspend, or discontinue AI services at any time

AI-generated content may be stored and processed on servers hosted by Hostinger UK Limited. See our Privacy Policy for details on data handling.

11. Notifications

The App provides notification services to remind you of upcoming events:

• Notifications are scheduled based on your preferences and device settings
• You may enable or disable notifications at any time through the App settings
• Notification delivery depends on your device's notification settings and battery optimization settings
• We are not responsible for missed notifications due to device settings, network issues, or other factors beyond our control
• Interactive notification actions are provided for convenience and may not be available on all devices or operating system versions.

12. Widget Services

The App provides home screen widget functionality:

• Widgets display information from your MyDates database
• Widget appearance and content are customizable through App settings
• Widget updates may be subject to device limitations and operating system system policies
• We are not responsible for widget display issues caused by device settings, launcher restrictions, or operating system updates

13. Holiday Database

The App has an access to a holiday database:

• Holiday information is provided "as is" for informational purposes
• We do not guarantee the accuracy, completeness, or timeliness of holiday information
• Holiday images and content are provided by third-party sources and may be subject to change

14. Intellectual Property

The App, including its design, features, functionality, and content (excluding user-generated content), is owned by Company or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove or alter any copyright, trademark, or other proprietary notices
• Use the App for any commercial purpose without our express written permission
• Share, distribute, or sublicense the App to third parties

15. User Responsibilities

You agree to:

• Use the App, Site, and Services only for lawful purposes and in accordance with these Terms
• Provide accurate and truthful information when creating events or using App features
• Maintain the confidentiality of your account credentials and export passwords
• Respect the privacy and rights of others when using App features
• Not use the App, Site, or Services to harass, abuse, or harm others
• Not attempt to gain unauthorized access to the App, Site, Services, or their systems
• Not interfere with or disrupt the App's, Site's, or Services' functionality or servers
• Comply with all applicable laws and regulations when using the App, Site, or Services

16. Prohibited Uses

You may not use the App, Site, or Services to:

• Violate any applicable local, state, national, or international law
• Infringe upon the rights of others, including intellectual property rights
• Upload, post, or transmit any content that is illegal, harmful, threatening, abusive, or offensive
• Impersonate any person or entity or falsely represent your affiliation
• Collect or store Personal Data (as defined in our Privacy Policy) about other users without their consent
• Use automated systems to access the App, Site, or Services without permission
• Attempt to circumvent security measures or access restricted areas
• Use the App, Site, or Services in any way that could damage, disable, or impair the App or its services

17. Data Storage and Backup

Your data is stored locally on your device and, if you choose, backed up to Google Drive:

• Local storage: Your event data is stored in a local database on your device
• Google Drive backup: If you enable backup, your data may be stored on Google Drive servers
• You are responsible for maintaining backups of your data
• We are not responsible for data loss resulting from device failure, app uninstallation, or other causes
• We recommend regular exports of your data for additional backup purposes

18. Service Availability

We strive to provide reliable and continuous access to the App, Site, and Services, but we do not guarantee:

• Uninterrupted or error-free operation of the App, Site, or Services
• That the App, Site, or Services will be available at all times
• That all features will function perfectly on all devices
• That the App will be compatible with all operating system versions or device configurations

We may temporarily suspend or modify the App's, Site's, or Services' functionality for maintenance, updates, or other reasons. We will make reasonable efforts to notify users of significant service interruptions when possible.

19. Infrastructure and Hosting

Our infrastructure is hosted by Hostinger UK Limited (6 Lloyds Avenue Suite 4CL London, England EC3N 3AX), a UK private limited company. Your Personal Data (as defined in our Privacy Policy) may be stored and processed on servers located in facilities managed by Hostinger. By using the App, Site, or Services, you acknowledge that:

• Your Personal Data may be stored and processed in locations outside your country of residence
• Data storage and processing are subject to Hostinger's terms and policies
• We rely on Hostinger's infrastructure for App functionality, and service availability depends on Hostinger's service levels
• We ensure that all international data transfers comply with applicable data protection laws, including implementing appropriate safeguards where required

20. Disclaimer of Warranties

THE APP, SITE, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT
• WARRANTIES THAT THE APP, SITE, OR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR QUALITY OF INFORMATION PROVIDED BY THE APP, SITE, OR SERVICES
• WARRANTIES THAT DEFECTS WILL BE CORRECTED OR THAT THE APP, SITE, OR SERVICES WILL MEET YOUR REQUIREMENTS

21. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• ANY LOSS OF PROFITS, REVENUE, DATA, OR USE
• ANY DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE APP, SITE, OR SERVICES
• ANY DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO OR USE OF YOUR PERSONAL DATA
• ANY DAMAGES RESULTING FROM THIRD-PARTY SERVICES OR INTEGRATIONS

Our total liability to you for any claims arising from or related to the App, Site, or Services shall not exceed the amount you paid to us (if any) for the App or Services in the twelve (12) months preceding the claim, but not more than one hundred U.S. dollars (US$100).

22. Indemnification

You agree to indemnify, defend, and hold harmless Company and its affiliates, directors, officers, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of or access to the App, Site, or Services
• Your violation of these Terms
• Your violation of any rights of another party
• Your user-generated content

23. Modifications to Service

We reserve the right to:

• Modify, suspend, or discontinue any aspect of the App, Site, or Services at any time
• Add, remove, or modify features or functionality
• Update the App with new features or bug fixes
• Change or discontinue support for certain devices or operating system versions

We will make reasonable efforts to notify users of significant changes to the App's, Site's, or Services' functionality, but we are not obligated to provide advance notice of all changes.

24. Termination

We may terminate or suspend your access to the App, Site, or Services at any time, with or without cause or notice, for any reason, including:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• At our sole discretion

You may stop using the App, Site, or Services at any time by uninstalling the App from your device or ceasing to access the Site. If you wish to delete your account and all associated data, please follow the instructions on our Account Deletion page. Upon termination, your right to use the App, Site, or Services will immediately cease. We are not obligated to provide you with access to your Personal Data after termination, so we recommend exporting your data before uninstalling the App or ceasing use of the Services.

25. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising from or related to these Terms or the App, Site, or Services shall be subject to the exclusive jurisdiction of the courts of England and Wales.

26. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

27. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Company regarding your use of the App, Site, and Services and supersede all prior agreements and understandings.

28. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Last Updated" date
• Providing notice through the App or Site when feasible

Your continued use of the App, Site, or Services after such changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App, Site, and Services.
